350.213 – What 18 items must a state CVSP include?

  • General Overview:
    Mission Statement Summary of prior years safety program outcomes
  • A description of how the state complies with 350.109:
    List activities for removing impaired drivers List activities for training MCSAP employees Interdiction activities on transport of controlled substances How 49 USC 13902 and 49 CFR 365 are enforced, also 49 USC 13906, 31138, 31139, and 49 CFR 387.
  • Problem statement for each objective with data support (include information source and who maintains).
  • Performance objectives which include a measurable reduction in highway accidents and hazmat accidents.
  • Plan for meeting performance objectives.
  • Activities to achieve strategies and objectives.
  • State performance measures.
  • Indicate how the state will monitor progress, including who will monitor, how often reports will be made, how reports will be made and to whom reports will be made.
  • Review prior year's report and identify problems and list as new objectives.
  • Create a detailed budget.
  • Budget summary along with planned purchases.
  • Report of annual review and how they maintain compatibility with state and local laws.
  • A copy of any new state laws or regulations implemented since the last CVSP.
  • Executed state certification.
  • Executed MCSAP-1 form.
  • List of MCSAP contacts.
  • Annual certification of compatibility.
  • State training plan.

350.215 – What happens if a state does not perform according to the grant?

  • The administrator will issue a written notice of nonconformity.
  • The state has 30 days to reply. The reply must address the nonconformity issues.
  • The administrator will review the state's reply and make a final decision.
  • If the state fails to reply or reply in time, the original notice becomes the final decision.
  • Adverse decisions stop all federal funding immediately.
  • States can seek redress through judicial review via 5 USC chapter 7.

350.301 – What effort must a state maintain in order to qualify?

  • The state must maintain the aggregate expenditures of the state, excluding federal funds and state matching funds for CMV safety programs.
  • The determination of the state's level of effort may not include federal funds designated for the MC and the hazmat CMV safety programs; state matching funds; nor state funds for federally sponsored CMV safety programs.
  • The state must detail funds already being used (or projected to receive) under this grant.

350.303 – What are the state and federal share of expenses incurred?

  • The FMCSA reimburses up to 80% of eligible costs.
  • In-kind contributions are acceptable to assist the state's matching share.

350.305 – Are US Territories subject to the matching funds requirement?

  • The requirements are waived for the Virgin Islands, American Samoa, Guam and the Northern Mariana Islands.

350.307 – How long are MCSAP funds available?

  • For the remainder of the current fiscal year and the next full fiscal year.

350.309 – What activities are eligible for reimbursement?

  • The five national programs listed in 350.109.
  • Sanitary food transportation inspections as listed in 49 USC 5708.
  • Non-weigh scale houses locations for enforcement of CMV size and weight.
  • Detection of unlawful controlled substances in a CMV.

350.311 – What specific items are eligible for reimbursement?

  • Personnel expenses including recruitment, screening, training salaries, fringe benefits and supervision.
  • Equipment and travel expenses as related to the enforcement of safety regulations.
  • Indirect expenses for facilities used for inspections and office space (does not include fixed scales) .
  • Data acquisition, storage and analysis specifically program related.
  • Clerical and administrative expenses for the MCSAP operation.
  • Improving real estate towards the inspection of vehicles.

350.313 – How are MCSAP funds allocated?

  • Administrative expenses per 49 USC 31104(e).
  • Safety audits for New Entrants Motor Carriers.
  • Basic program funds as per 350.323.
  • Incentive funds per 350.327.
